Statement from the Registrar: Settlement on tires 2023 minimum collection requirement
The Registrar and the tire producer responsibility organization (PRO) eTracks have reached a settlement on behalf of 29 of eTracks’ producer clients that did not meet their 2023 minimum collection requirements under O Reg 225/18 (Tires Regulation).
Under the terms of the settlement, eTracks has agreed to make a payment totaling $7,440,900, and RPRA’s Deputy Registrar will not issue Administrative Penalty (AP) Orders to the following tire producers: BMW Canada Inc.; Bridgestone Canada Inc.; Continental Tire Canada Inc.; Daimler Trucks Canada LTD; Tirelink and DT Tire (incl. National Tire Distributors Inc.); Ford Motor Company of Canada Limited; General Motors of Canada Company; Goodyear Canada Inc.; Hankook Tire Canada Corp.; Hino Motors Canada Ltd; Hyundai Auto Canada Corp.; Jaguar Land Rover Canada ULC; John Deere Canada ULC; Kia Canada Inc.; Kubota Canada Ltd; Kumho Tire Canada, Inc.; Mazda Canada Inc.; Mercedes-Benz Canada; Mitsubishi Motor Sales of Canada Inc.; Nissan Canada Inc.; OK Tire Stores Inc; Pirelli Tire Inc.; FCA Canada Inc.; Subaru Canada, Inc.; The Carlstar Group ULC; Thomas Built Buses of Canada, LTD; Toyo Tire Canada Inc.; Volkswagen Group Canada Inc.; and Yokohama Tire (Canada) Inc.
The funds will be used for the purposes of supporting and incentivizing the outcomes of the Tires Regulation and the Resource Recovery and Circular Economy Act, 2016 (RRCEA). RPRA will report on the use of the settlement funds in its annual report.
This settlement is consistent with the principles of holding all producers accountable, supporting a level playing field, and promoting the achievement of regulatory objectives.
It ensures a level playing field because some tire producers reported that they achieved or exceeded the minimum collection requirements while some reported that they did not, including due to the unavailability of tires. Evidence indicates that service providers and all PROs were able to collect all available used tires in the province in 2023, and that used tires collected were appropriately managed.
This settlement concludes RPRA’s compliance and enforcement action against these tire producers for not meeting their 2023 minimum collection requirements. As previously disclosed, on March 21, 2025, RPRA’s Deputy Registrar issued amended Notices of Intention to 46 tire producers who did not meet their 2023 minimum collection requirements. By the end of the notice period, 17 of 46 provided evidence that they met the 2023 minimum collection requirements.
